Fulton County DA Fani Willis’ case against Donald Trump just hit a serious roadblock, thanks to Fulton County Superior Court Judge Scott McAfee. He’s thrown out three more charges from the sprawling indictment that claims Trump and his allies were trying to mess with Georgia’s 2020 election results. This is a big deal because these charges were central to Willis’ argument that Trump was part of a “coordinated effort” to overturn Biden’s supposed win in the state.
Judge McAfee didn’t pull any punches when he tossed out two criminal charges against Trump and another against one of his key allies. Oh, and this isn’t the first time McAfee’s done this. Earlier this year, he already axed three other counts for being too vague. So, the grand total is now five charges dismissed—and while Willis’ case can still go on, this sure takes the wind out of her sails.
The charges that got the boot revolved around Trump’s alleged plan to send an alternate set of electors to D.C., basically claiming Trump won Georgia when he didn’t. McAfee ruled that these actions clashed with federal law. His ruling called out the Supremacy Clause, which says federal law trumps state law when they conflict (pun intended).
Trump’s legal team, led by Steve Sadow, wasted no time declaring victory. “President Trump and his legal team in Georgia have prevailed once again,” Sadow said, basking in the glow of another win in what feels like the never-ending legal battles surrounding Trump.
This has to be a tough pill for Willis to swallow. She’s been riding high on her indictment that initially had 19 defendants and 41 charges. Her strategy was to paint Trump and his team as the masterminds of a grand conspiracy to steal Georgia’s election, but with these key charges dropped, that narrative’s starting to unravel. And remember, this whole thing began with Willis launching her probe in February 2021, which turned into a full-blown grand jury investigation. Now, two years and a pile of dismissed charges later, her case is looking a lot shakier.
At the end of the day, Trump has always claimed these indictments are politically motivated. With each ruling in his favor, that claim doesn’t seem so outlandish anymore, does it?
